An experimenting society is one in which policy-relevant knowledge is created. It is then critically assessed and communicated in real-life or natural settings, with the aim of discovering new forms of public action to improve the problem-solving capacities of society. This latest volume of the distinguished Policy Studies Review Annual series probes, evaluates, and augments the work of Donald T. Campbell on an experimental societies. A basic assumption of this volume is that Campbell's perspective supplies a useful way to address (...) increasingly complex and seemingly unmanageable problems facing the United States and other postindustrial societies. This volume is also the fourteenth festschrift to be issued by Transaction. The focus is on theoretical as well as practical options for creating an experimenting society. The rationale for this focus is the belief, increasingly -shared in the social science and policy-making communities alike, that researchers are essentially ignorant about how to solve many of the most pressing larger problems of this epoch. This frank recognition of ignorance is a prerequisite of genuine scientific and professional curiosity, without which knowledge gains are next to impossible to achieve, and a'precondition of an experimenting society. "Uprightness" was termed the "leitmotiv in the formation of the human organism" by Erwin Straus (1966, p. 139). He felt that without it the human being was certainly doomed to die. Yet, what happens with those who are deprived of their "uprightness" in either the literal or moral sense (as in "not to stoop to anything"), through becoming Dis-abled? Getting up, rising in opposition to the "other" (Allon) implies a moral dimension in the case of human Dis-ability which is tied (...) to the leitmotiv established by the upright posture of anthropos . The suggestion that there is a moral dimension to Disability is a radical notion in a culture whose health professionals have become very sensitive to any idea that suggests we are blaming those who through no fault of their own have become in some way disadvantaged as compared to the mainstream of society. Although the importance of rising in opposition to the world (Allon) was perhaps originally established upon the upright posture quite literally, because man is a sense-making and sense-giving creature, this primordial act which establishes our full humanity may itself be represented and re-enacted in a variety of ways which can and should become the central project of rehabilitation of the body, as opposed to the current emphasis on technique and technological innovation. It is in the changing physiognomy of the Dis-abled person's ruptured world that we may discover the phenomenological sense of Dis-ability. Expenditures on health in many developing countries are being disproportionately spent on health services that have a low overall health impact, and that disproportionately benefit the rich. Without explicit consideration of priority setting, this situation is likely to remain unchanged: resource allocation is too often dictated by historical patterns, and maintains vested interests. This paper explores how prioritization between different health interventions can be rationalised by the use of clearly defined criteria. Abstract:This paper develops a framework for examining decision making about ethical issues and tests the applicability of a social contract perspective. Using two separate samples of students and salespeople, we determine that community members (salespeople) tend to judge a potentially unethical act to constitute a violation of an implicit social contract and non-community members (students) do not. Also, consistent with the emphasis on context specificity of integrative social contracts theory, situational variables influence perceptions of ethicality for the community members, but (...) do not affect the perceptions of individuals outside the community. This article examines how the historian deals with ‘information’ broadly conceived, especially its acquisition, retention and loss. Ammianus details a complex interplay between those who control information and those who must work with an information deficit. Just as this dialogue plays out within the text, however, so too does it with respect to the author's methodology, which dances between the poles of incomplete and complete information depending on circumstance. The development and deployment of medical devices, along with most areas of healthcare, has been significantly impacted by the COVID-19 pandemic. This has had variable ethical implications, two of which we will focus on here. First, medical device regulations have been rapidly amended to expedite approvals of devices ranging from face masks to ventilators. Although some regulators have issued cessation dates, there is inadequate discussion of triggers for exiting these crisis standards, and evidence that this may not be feasible. Given (...) the relatively low evidence standards currently required for regulatory approval of devices, this further indefinite reduction in standards raises serious ethical issues. Second, the pandemic has disrupted the usual operations of device representatives in hospitals, providing an opportunity to examine and refine this potentially ethically problematic practice. In this paper we explain and critically analyse the ethical implications of these two pandemic-related impacts on medical devices and propose suggestions for their management. These include an endpoint for pandemic-related adjustments to device regulation or a mechanism for continued refinement over time, together with a review of device research conducted under crisis conditions, support for the removal and replacement of emergency approved devices, and a review of device representative credentialling. Constructive engagement in international business practice is defined as purpose-driven behavior in which economic contributions by the foreign investor also advance social progress in the host country. This paper distinguishes between amoral and moral social agency, and proposes a model of principled constructive engagement that describes a principled constructive engagement regime enacted in a disciplined, morally-directed manner.

Chlorpromazine efficacy in schizophrenia was observed 60 years ago. Advances in pharmacotherapy of this disorder have been modest with effectiveness still limited to the psychosis psychopathology and mechanism still dependent on dopamine antagonism. While a look backward may generate pessimism, future discovery may be far more robust. The near future will see significant changes in paradigms applied in discovery. Rather than viewing schizophrenia as a disease entity represented by psychosis, the construct will be deconstructed into component psychopathology domains. Each domain (...) will represent a clinical target for aetiologic and therapeutic discovery. Research on pathophysiology will shift to the neural circuit level in relation to specific behavioural constructs. Progress at the molecular, genetic, cellular and network levels will be more robust. The behavioural paradigm will map on to the deconstructed clinical paradigm and in the process discovery will cut across current classification boundaries. (shrink)

One of the central methodological issues for contemporary practitioners of comparative ethics is how to conceptualize and relate to the "other" encountered in cross-cultural studies. A valuable resource for reflection on this problem is the work of the French historian and cultural theorist Michel de Certeau, whose diverse opus coheres around his notion of heterology--a "science of the other." In this article I explore perspectives on the cultural "other" emerging from Certeau's analyses of a series of "travel narratives" documenting the (...) European encounter with the peoples of the New World. Certeau's meditations on the metaphor of the voyage, the interplay of orality and literacy, the politics of ethnography, and the semiotics of the "return of the repressed" offer, I suggest, important insights for comparative ethicists. A significant number of inmates with mental illness reside within the New York State Department of Corrections (NYSDOCS). New York State has taken the initiative to provide mentally ill inmates with necessary services through a collaboration of the New York State Department of Correctional Services and the New York State Office of Mental Health (NYSOMH). The collaboration results in a mental health delivery system that provides many essential services to mentally ill inmates. This paper focuses on the organization of mental (...) health services within NYSDOCS, best practices, past and current litigation, and staff responsibilities. As the population of mentally ill inmates continues to grow, implications for the Human Services professions of OMH and DOCS needs to continue to address and provide adequate mental health care and resources for this special population. Others may charge this equivalence as hyperbole, but the numbers betray a system of racialized injustice that people of good will ought to reject today as did like-willed people of the churches, synagogues, and community organizations of the years leading up to the civil rights movement and beyond. According to Scheck, Newfeld, and Dwyer (2000), there have been innumerable individuals wrongly convicted of a crime and sentenced to life imprisonment or to death based upon faulty evidence. The historical development of DNA evidence as a tool in the investigative process during the past 25 years is explained/analyzed, and the role of eyewitness evidence in the wrongful conviction of innocent individuals. This paper culminates in the Anthony Capozzi case study where eyewitness testimony wrongfully imprisoned a man before the advent (...) of DNA technology and which ultimately freed him years after the crime. The methodology used is the examination of journal articles, books, and newspaper articles on the phenomenon of wrongful convictions. (shrink)

IntroductionThere is an enormous amount of confusion about what relativism is. In this paper I aim to take a step toward clarifying what it is by discussing some things that it is not — that is, by distinguishing it from some other views with which it is often confused or conflated, such as nihilism and scepticism. I do this primarily because I think that the question of the character of relativism is interesting in itself. A clearer characterization of relativism would (...) also be important instrumentally, however, as before we can accurately assess relativism we must have a clear idea of what it is. The secondary aim of this paper, then, is to function as a prolegomenon to an assessment of relativism. The tertiary aim of the paper is to make a few observations about the view which most clearly stands opposed to relativism, the view which I will call ‘objectivism.’ Because relativism is often confused with views like fallibilism and pluralism, objectivism often finds itself unjustly associated with views like infallibilism and political authoritarianism. Although it is not the point of this paper to criticize relativism, I should make it clear that it began as a part of an anti-relativistic project, and, although anti-relativism is not necessarily objectivism, I should perhaps make it clear that I am more than a little sympathetic to the latter type of view. This essay explores how the doctrine of the Resurrection informs theological reflection on reconciliation in post‐Apartheid South Africa. It begins by establishing the fragile and liminal state of reconciliation, despite the efforts of the Truth and Reconciliation Commission. It then argues that the Resurrection offers an ecstatic and relational understanding of the human, which in turn provides a basis for advancing claims regarding human dignity and well‐being. In conversation with the work of Oliver O'Donovan and James Alison on the Resurrection, (...) this view is further contextualized by incorporating insights from ubuntu and from the work of Judith Butler on grieving. The essay closes with proposals for how the church in post‐Apartheid South Africa can give witness to the Resurrection in its immediate life and work through advocacy and carrying on the politics of grieving. Michael Ruse's Darwin and Design: Science, Philosophy, Religion explains the history and philosophical arguments of the design metaphor of evolution. It recounts the historical uses of the metaphor from Plato to twentieth‐century American science. Ruse explores the criticisms of the design metaphor and ultimately concludes that it is a beneficial term. The chief contribution of Darwin and Design is that it offers a clear understanding and comparison of the argument from design and the argument to design.

Critics and defenders of William James both acknowledge serious tensions in his thought, tensions perhaps nowhere more vexing to readers than in regard to his claim about an individual’s intellectual right to their “faith ventures.” Focusing especially on “Pragmatism and Religion,” the final lecture in Pragmatism, this chapter will explore certain problems James’ pragmatic pluralism. Some of these problems are theoretical, but others concern the real-world upshot of adopting James permissive ethics of belief. Although Jamesian permissivism is qualified in certain (...) ways in this paper, I largely defend James in showing how permissivism has philosophical advantages over the non-permissivist position associated with evidentialism. These advantages include not having to treat disagreement as a sign of error or irrationality, and mutual support relations between permissivism and what John Rawls calls the "reasonable pluralism" at the heart of political liberalism. Rational-choice theory is pervasive in legal theorizing. Most law and economics work assumes that human beings make decisions that are rational as to both their ends and means. Decisions are ends-rational if they are directed at goals that satisfy the person's utility function; decisions are means-rational if they adopt methods reasonably connected to achieving those goals. Institutionalist theory assumes that institutions are composed of actors pursuing their own rational ends by rational means and, further, that those institutions themselves can be (...) said to have rational ends pursued by rational means. Most rational-choice theorizing in law is positive: Thinkers are using the theory as a stylized way of describing patterns of behavior or predicting expected behavior. Such theorizing can also be normative: Rationality of ends and means is an aspiration of human and institutional actors, and law can improve upon existing behavior through rules, procedures, and structures. This article describes the racial integration of Emory University and the subsequent creation of Pre-Start, an affirmative action program at Emory Law School from 1966 to 1972. It focuses on the initiative of the Dean of Emory Law School at the time, Ben F. Johnson, Jr.. Johnson played a number of leadership roles throughout his life, including successfully arguing a case before the United States Supreme Court while he was an Assistant Attorney General of Georgia, promoting legislation to create Atlanta (...) 's subway system as a state senator, and representing Emory in its lawsuit to strike down the state statute that would have rescinded its tax exemption if it admitted African American students ). This account supplements my related article on Pre-Start, "'A Bulwark against Anarchy': Affirmative Action, Emory Law School, and Southern Self-Help", providing more information about historical context generally, and particularly about Emory v. Nash. Johnson was ambitious for Emory as a whole, and particularly for the Law School, and he saw in segregation the single largest impediment to making Emory a nationally prominent research university. The story of Emory's integration, and Johnson's leadership, requires revision of the prevailing story of integration generally, and especially of universities. Integration at Emory came about because of the pressure that African Americans and their supporters created through the civil rights movement, but Emory administrators responded to such pressure more constructively than most. Their actions provide an interesting case study in effective leadership during a period of significant moral and political conflict. (shrink)

Who is to be included in a political community and on what terms? William A. Barbieri Jr. seeks answers to these questions in this exploration of the controversial concept of citizenship rights—a concept directly related to the nature of democracy, equality, and cultural identity. Through an examination of the case of Germany’s settled “guestworkers” and their families, _Ethics of Citizenship_ investigates the pressing problem of political membership in a world marked by increased migration, rising nationalist sentiment, and the ongoing reorganization (...) of states through both peaceful and violent means. Although some of Germany’s foreign workers have gradually attained a degree of social and economic legitimacy, Barbieri explains how they remain effectively excluded from true German citizenship. Describing how this exclusion has occurred and assessing current attitudes toward political membership in Germany, he argues for a just and democratic policy toward the tax-paying, migrant worker minority, one that would combine the extension of the individual rights of citizenship with the establishment of certain group rights. Through a dissection of ongoing public “membership debates” over issues such as suffrage, dual citizenship, and immigration and refugee policy, Barbieri identifies a range of competing responses to the question of who “belongs” in Germany. After critiquing these views, he proposes an alternative ethic of membership rooted in an account of domination and human rights that seeks to balance individual and group rights within the context of a commitment to democracy and equal citizenship. Indispensable for scholars of German studies, _Ethics of Citizenship_ also raises questions that will attract moral philosophers, constitutional scholars, and those interested in the continuing, global problems associated with migration.
